Authorising someone in Colombia to act on your behalf usually requires a power of attorney signed in front of a notary public (poder notarial) and an apostille (apostilla).

Autorizar a alguien en Colombia para que actúe en su nombre suele requerir un poder notarial firmado ante un notario público y una apostilla.

¿Qué es apostilla?

La apostilla es certificar la autenticidad de la firma de funcionarios públicos o agentes diplomáticos en ejercicio de sus funciones y la calidad en que hayan actuado, la cual deberá estar registrada en la base de datos del Ministerio de Relaciones Exteriores, para que el documento sea válido y surta efectos legales en otro país miembro del Convenio de la Haya de 1961, sobre la abolición del requisito de legalización para documentos públicos extranjeros.

As Australia and Colombia are both members of the Apostille Convention, documents from Australia (like the power of attorney) to be used in Colombia must be stamped with an apostille.

Como Australia y Colombia son ambos miembros de la Convención de la Haya, los documentos de Australia (como el poder notarial) que se van a utilizar en Colombia deben ser sellados con una apostilla.

In Australia, the issuing authority for the apostille is the Department of Foreign Affairs and Trade (DFAT). DFAT can stamp an apostille on public documents, being original Australian government documents, or documents that have been notarised by an Australian notary public. Accordingly, as the power of attorney signed in Australia is a private document, it must be notarised before it can be stamped with an apostille.

En Australia, la autoridad que expide la apostilla es el Departamento de Asuntos Exteriores y Comercio (DFAT). DFAT puede sellar una apostilla en documentos públicos, que son documentos originales del gobierno australiano, o en documentos que han sido notarizados por un notario público australiano. Por lo tanto, como el poder notarial firmado en Australia es un documento privado, debe ser notariado antes de que se le pueda sellar una apostilla.

Since your power of attorney will be used in Colombia, it should be written by your lawyer in Colombia. This ensures that the power of attorney is valid according to the law in Colombia. It can be written in Spanish and it doesn’t require translation for it to be notarised or stamped with an apostille in Australia.

Dado que su poder notarial se utilizará en Colombia, debe ser redactado por su abogado en Colombia. Esto garantiza que el poder notarial sea válido de acuerdo con la ley en Colombia. Puede ser escrito en español y no requiere traducción para ser notariado o apostillado en Australia.

What information should the power of attorney contain? ¿Qué información debe contener el poder notarial?

Your lawyer in Colombia should advise you on the form and format of your power of attorney. It largely depends on who you’re authorising and what you’re authorising them to do for you. In most cases, your power of attorney will include your full legal name and your identity number as well as your attorney’s full legal name and identity number. Specifying the authority properly and completely is important to ensure that your power of attorney will be effective in achieving what you want it to achieve. You might be able to find various templates on the internet of different power of attorney that other people use, however, you should always seek your own specific advice regarding what you want to do and the most relevant power of attorney for that purpose.

Su abogado en Colombia lo debe asesorar sobre el formato y la forma de su poder notarial. Depende en gran medida de a quién autorice y de lo que lo autorice a hacer por usted.
